LandmarX Terms of Use

These Terms of Use ("Terms") govern your use of the LandmarX mobile application and services (collectively, the "Services") provided by LandmarX, Inc. ("LandmarX," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

1. Eligibility

By using LandmarX eSIM, you represent that you are at least 18 years old or have the permission and supervision of a parent or legal guardian. You also confirm that you have the legal authority to enter into these Terms of Use and comply with all applicable laws and regulations.

2. Use of Services

LandmarX eSIM provides digital eSIM products, travel connectivity services, and related travel tools for personal, non-commercial use. You agree to use the services only for lawful purposes and in accordance with these Terms. Service availability, network quality, speed, and coverage may vary depending on destination, carrier partnerships, device compatibility, and local regulations.

3. Account Registration

Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to provide accurate, current, and complete information during registration and to update such information when necessary.

4. Payment

All purchases made through LandmarX eSIM are processed securely through third-party payment providers. Prices are displayed in the applicable currency and may be subject to taxes, exchange rates, or additional processing fees depending on your payment method and region. By completing a purchase, you authorize the applicable charges for the selected eSIM products or services.

5. Refund Policy

eSIM purchases may be eligible for refunds within 90-180 days from purchase only if the eSIM has not been activated or used. Once an eSIM has been activated, installed, or consumed, the purchase becomes non-refundable except where required by applicable law. Refund requests may require proof of technical issues or service failure. Promotional purchases, discounted plans, and subscription services may have separate refund restrictions.

6. Fraudulent Transactions

LandmarX reserves the right to review, suspend, cancel, or terminate any transaction, account, or eSIM purchase that is suspected of involving fraudulent activity, unauthorized payments, stolen credit cards, payment abuse, chargeback abuse, identity theft, or violations of applicable financial or telecommunications regulations.

We may request additional verification information to confirm the legitimacy of a transaction before activation or delivery of an eSIM product. Transactions flagged by our payment processors, fraud detection systems, banking partners, or internal security reviews may be delayed, canceled, or permanently restricted without prior notice.

LandmarX further reserves the right to deny future purchases, suspend accounts, deactivate services, and cooperate with financial institutions, payment providers, telecommunications partners, and law enforcement authorities in connection with suspected fraudulent activity.

7. Intellectual Property

All content, branding, software, logos, graphics, text, design elements, and technology associated with LandmarX eSIM and LandmarX.ai are the property of LandmarX or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or exploit any portion of the services without prior written consent.

8. Prohibited Conduct

You agree not to:

Use the services for unlawful, fraudulent, or abusive activities
Attempt to gain unauthorized access to systems or networks
Interfere with the operation or security of the platform
Resell, redistribute, or commercially exploit eSIM products without authorization
Use automated systems, bots, scraping tools, or data extraction methods against the platform
Violate any carrier, telecommunications, or local regulatory requirements

LandmarX reserves the right to suspend or terminate access for violations of these Terms.

9. Third-Party Services

Certain features, payment processing, carrier connectivity, mapping tools, analytics, and telecommunications services may be provided through third-party providers. LandmarX is not responsible for the availability, performance, accuracy, or policies of third-party services or networks.

10. Disclaimer of Warranties

The services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. LandmarX does not guarantee uninterrupted service, continuous network availability, compatibility with all devices, or error-free operation. Coverage and performance may vary based on local carriers, device models, geographic conditions, and other external factors.

11. Limitation of Liability

To the maximum extent permitted by law, LandmarX and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, business interruption, travel disruption, roaming charges, or connectivity issues arising from the use or inability to use the services. Total liability shall not exceed the amount paid by the customer for the affected eSIM product or service.

12. Indemnity

You agree to defend, indemnify, and hold harmless LandmarX, its affiliates, partners, officers, employees, and licensors from any claims, damages, liabilities, costs, or expenses arising from your misuse of the services, violation of these Terms, infringement of third-party rights, or unlawful conduct.

13. Modifications

LandmarX reserves the right to modify, update, or discontinue any portion of the services or these Terms at any time without prior notice. Continued use of the services following any modifications constitutes acceptance of the updated Terms.

15. Termination

LandmarX may suspend or terminate your access to the services at its discretion if it believes you have violated these Terms, engaged in fraudulent activity, or created security or operational risks. Upon termination, your right to use the services immediately ceases.

16. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the services shall be resolved in the appropriate courts located in California.
